You finally got your Work Permit. So what are your rights?
You are happy because you have obtained your permit to work legally in Canada and you are ready to start a new stage in the country of the maple leaf. Every new adventure brings many illusions but also responsibilities. It is important that you take into account your rights and obligations as an employee.
Today we want to highlight some of the rights set out in the Employment Standards Act for the province of Ontario. Keep in mind that this is not a legal document, in which case you should consult a certified employment advisor.
Let's get started:
You have the right to be treated fairly at work.
The workplace must be safe and comply with health and safety measures.
If your job involves any kind of risk, you must be trained for it.
You also have the freedom and right to belong to a labor union.
Going back to point number one, fair treatment means receiving the salary that was stipulated for the workday you are going to perform. If you are asked to work overtime there is also compensation for that. It is important to know this information beforehand. Do not be afraid to ask your human resources department or your immediate supervisor.
Each province in Canada has its official rest days and holidays. Have a calendar with the official days on hand so you can plan your rest or family outings. If you are scheduled to work on those days, you will receive special pay. This information is also important to know in advance.
And what do Canadian laws say about vacations?
Most employees get at least two weeks of vacation every 12 months. They are entitled to be paid at least four percent of their total earned salary as vacation pay. Any unpaid vacation pay is due to the employee upon termination of employment.
Another very important aspect is deductions from your salary. These are the mandatory ones, which are taxes, which are used for all of us to enjoy the services and security that Canada offers us. The other type of deductions are court ordered and the other type of deductions are the ones that you have negotiated or accepted when signing the employment contract.
This is the basic information you should know, but do not forget that every situation should be advised by someone qualified. Do not be afraid to ask your superiors, it is your right.
